To thoroughly implement the spirits and requirements of the Supreme People’s Court’s documents- Opinions on Further Deepening the Reform of Diversified Dispute Resolution Mechanisms by the People’s Courts, the Provisions on Specially Invited Mediation by the People’s Courts, and Opinions on the Establishment of a One-stop Diversified Dispute Resolution Mechanism and One-stop Litigation Service Center, to further deepen the reform of the conflict resolution mechanism, to strengthen the connection of litigation and mediation, and to promote social harmony and stability, DHH Jianjiacong Yongben Jinyue (Qianhai) Associated Law Firm (hereinafter referred to as "DHH Associated Firm") and the People’s Court of Shenzhen Qianhai Cooperation Zone (hereinafter referred to as "Qianhai Court") signed a framework agreement on August 5, 2020, regarding the establishment of a diversified conflict resolution work cooperation mechanism, establishing international commercial mediation center.
As an organization responsible for the diversified resolution of international commercial disputes, the International Commercial Mediation Center of DHH Associated Firm leverages the advantages of the three-location joint venture to play the role of special foreign mediators, to improve the neutral evaluation mechanism of foreign disputes, and to find more information-based foreign dispute resolutions. It provides convenient, efficient, and authoritative dispute resolution services for commercial entities inside and outside the territory.
The center also focuses on the three major functional systems of "project docking, risk resolution, and dispute mediation" to provide "one-stop, full-process, and all-round" legal, financial, insurance, financial, consulting and dispute mediation comprehensive services for the construction of the One Belt One Road and enterprises going global.
DHH Associated Firm is established by Beijing DHH Law Firm, Hong Kong Jian Jiacong Law Firm, and Macau Liang Yongben Li Jinyue Law Firm. It is the first three-place joint law firm in Shenzhen. The person in charge of the Mediation Center is Hong Kong Lawyer Xian Mingyu, who has taught mediation and negotiation courses for government departments, commercial organizations or other organizations many times, and actively participates in courses of the School of Professional and Continuing Education of the University of Hong Kong and other institutions, including government departments and professional/educational institutions as a tutor and coach. He has served as a full-time mediator since 2011 and has extensive experience in commercial litigation, property-related litigation, arbitration, insurance, and personal injury litigation. He is able to conduct targeted mediation and achieve satisfactory results.
According to the relevant provisions of the "Implementation Measures for the Pilot Reform of the Separation of Complex and Simplified Civil Procedures", if the parties to an international commercial dispute choose a special mediation organization for mediation, the mediation shall be under the jurisdiction of the basic people's court where the mediation organization is located. DHH Associated Firm is the specially invited mediation agency of the People’s Court of Shenzhen Qianhai Cooperation Zone. If the parties choose it as the mediation agency, after successful mediation of the case, both parties to the mediation can jointly report to Shenzhen Qianhai Cooperation Zone, and the people's court would apply for judicial confirmation. Such an institutional arrangement can uniformly resolve disputes that occur in various regions in the People's Court of Shenzhen Qianhai Cooperation Zone, which could greatly reduce the inconvenience caused by jurisdictional issues, and also enable successful mediation cases to be effectively confirmed and executed.
